This page (together with the documents referred to on it) tells you the terms and conditions on which we supply any of the products (Products) listed on our website www.ajhorseboxes.co.uk (our site) to you. Please read these terms and conditions carefully before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions.

Our site is only intended for use by people resident in the United Kingdom.

1. INFORMATION ABOUT US

1.1 www.ajhorseboxes.co.uk is a site operated by AJ Horseboxes Ltd (we). Our main trading address is Units B1 & B2, Dalton Moor, Dalton, THIRSK, North Yorkshire, YO7 3JD.

2. CLIENT STATUS

By placing an order with AJ Horseboxes Ltd, you ‘the Client’ warrant that:

(a) You are legally capable of entering into a binding contract;

(b) You are at least 18 years old;

(c) You are resident in the United Kingdom; and

(d) You are accessing our site from the United Kingdom.

3. HOW THE CONTRACT IS FORMED BETWEEN THE CLIENT AND AJ HORSEBOXES LTD

3.1 Goods

3.1.1 From initial contact your details will be filed in our system, an Invoice will be raised for supply of new products. Payment of the Invoice will form the contract between the Client and AJ Horseboxes Ltd.

3.2 Repairs & Service

3.2.1 From initial contact your details will be filed in our system, an Estimate will be raised from information supplied, physical inspection and supply of new products / services. Approval of the Estimate will form the contract between the Client and AJ Horseboxes Ltd.

3.3 Manufacturing and Supply of Bespoke AJ Horseboxes Ltd Product

3.3.1 From initial contact your details will be filed in our system, a Build Specification will be drawn up. Approval of the Build Specification Estimate will form the contract between the Client and AJ Horseboxes Ltd.

3.3.2 Approval of the Build Specification Estimate legally binds the Client to meet the finances and deadlines for the deposit, interim payments, and final balance owing as set out in the Payment Schedule for the build.

4. SERVICE

Estimates are given and orders accepted subject to the following conditions:

4.1 Estimates are open for acceptance up to seven days from the date of Estimate.

4.2 Jobs are booked in on a first come first served basis.

4.3 Times on repair jobs may alter once we get into them. If additional issues such as rotten/corroded/broken parts etc. become apparent, AJ Horseboxes Ltd cannot be held responsible for additional timescales & costs.

4.4 The Client will be notified of any work/parts required over and above the original Estimate, the Client’s approval will be sought prior to any additional work taking place or parts being ordered.

4.5 AJ Horseboxes Ltd will agree to re-fit any existing parts/appliances approved by the client. We will check that these parts are in working order before we re-fit, but once we have re-fitted we cannot be held responsible if these become inoperable due to wear and tear.

4.6 AJ Horseboxes Ltd may at times offer advisories of work that will be required in the very near future. AJ Horseboxes Ltd cannot be held responsible for failure of these parts.

4.7 AJ Horseboxes Ltd will contact the Client through the methods agreed by the Client.

4.8 AJ Horseboxes Ltd aims to provide a high quality service at all times. If the Client wishes to discuss with AJ Horseboxes Ltd on how to improve our service or if the Client is dissatisfied with the service received, please let AJ Horseboxes Ltd know immediately via email to sales@ajhorseboxes.co.uk.

5. DELIVERY

5.1 Every effort will be made to meet the delivery dates estimated, but AJ Horseboxes Ltd shall not be liable for losses incurred due to late delivery / completion, which are out of our hands.

5.2 Risk of damage or loss of the vehicle will pass to the Client upon delivery or collection of the vehicle.

6. PAYMENTS

6.1 Payment is due either before collection/delivery of vehicle/goods by Bank Transfer or upon collection of the vehicle/goods by card.

6.2 All deposits are non refundable.

6.3 A 25% deposit will be required to confirm any order over £500. Larger projects over £1,000 will require a 33% deposit, 33% interim payment, with 34% final balance. Please note that if the client cancels the work to be carried out within 24 hours of the date the work is booked in, there will be a 15% surcharge due to inconvenience and having to reschedule work. The 15% surcharge will be based on the deposit paid.

6.4 All goods shall remain the property of AJ Horseboxes Ltd until payment in full has been made.

6.5 AJ Horseboxes Ltd reserves the right to hold all goods or vehicles until payment is received in full.

6.6 Should it be necessary to take legal action to recover overdue amounts all costs involved will be charged to and payable by the Client.

6.7 Claims for goods in respect of non-delivery or damage in transit must be notified to us within 24 hours via email to sales@ajhorseboxes.co.uk.

7. TERMINATION

7.1 Both parties are entitled to terminate the contract at any time giving notice in writing. Termination will be when AJ Horseboxes Ltd halts the work / goods supplied.

7.1.1 Termination of the contract by the Client part way through a job will require payment in full for jobs completed / products supplied.

7.1.2 Termination of the contract by AJ Horseboxes Ltd will only be as a last resort. Payment in full for services, products and repairs rendered will be required from the Client.

7.1.3 AJ Horseboxes Ltd reserves the right to hold all goods or vehicles until payment is received in full.

8. WARRANTY

8.1 Sale of Goods

8.1.1 Any products supplied by AJ Horseboxes Ltd are guaranteed against fault for a period of 1 month from the date of dispatch from AJ Horseboxes Ltd and will be repaired or replaced free of charge at the discretion of AJ Horseboxes Ltd upon inspection, when the goods in question are returned to AJ Horseboxes Ltd.

8.1.2 AJ Horseboxes Ltd bespoke products are guaranteed against faulty materials and workmanship for a period of 6 months from the date of dispatch from AJ Horseboxes Ltd and will be repaired or replaced free of charge at the discretion of AJ Horseboxes Ltd upon inspection, when the goods in question are returned to AJ Horseboxes Ltd.

8.1.3 AJ Horseboxes Ltd liability will be confined solely to the invoiced value of the goods and will not include any other losses or damage, delivery or carriage charges, however caused.

8.1.4 There is a 25% re-stocking fee on non-faulty goods that are returned.

8.1.5 Special Order Goods cannot be returned.

8.1.6 Any damages must be reported to AJ Horseboxes Ltd within 24hrs of receipt of goods to receive a full refund or replacement.

8.2 Repairs & Service

8.2.1 New Mechanical Parts supplied are covered under their own manufacturer’s warranty, not AJ Horseboxes Ltd.

8.3 Manufacturing and Supply of Bespoke AJ Horseboxes Ltd Product.

8.3.1 The AJ Horseboxes Ltd chassis is guaranteed against faulty products and workmanship for a period of 3 months from the date of collection from AJ Horseboxes Ltd. Any faulty products or workmanship will be repaired or replaced free of charge upon inspection, at the discretion of AJ Horseboxes Ltd.

8.3.2 The AJ Horseboxes Ltd build is guaranteed against faulty materials and workmanship for a period of 12 months from the date of collection from AJ Horseboxes Ltd. Any faulty materials and workmanship will be repaired or replaced free of charge upon inspection, at the discretion of AJ Horseboxes Ltd.

8.4 Misuse, abuse, overloading, faulty installation or lack of maintenance renders any warranty void on all parts supplied for the client to fit themselves.

8.5 AJ Horseboxes Ltd do not guarantee zinc plating or other protective coatings, where AJ Horseboxes Ltd have no control over the operating environment.

9. INSURANCE COVER

9.1 AJ Horseboxes Ltd insurance does not include vehicle contents cover. Anything left in the vehicle is done so at the client’s discretion.

10. CONFIDENTIALITY

10.1 Information that the Client provides to AJ Horseboxes Ltd is on a confidential nature and will at all times be kept confidential, except as required by law or as provided for in regularity, ethical or other professional requirements applicable to this engagement.

11. FORCE MAJEURE

11.1 AJ Horseboxes Ltd will have no liability to the Client for any loss or damage arising out of circumstances outside our reasonable control including, without limitation, any strikes, labour disputes, fires, floods, accidents or breakdown of equipment, or breach of contract by our own suppliers. In any such circumstances AJ Horseboxes Ltd shall be entitled at any time, without prejudice and within our rights to cancel the contract.

12.1 These conditions of sale are governed by the law of England and Wales.

13. PRIVACY STATEMENT

13.1 Your right to privacy is an important concern to us and we wish to protect the privacy of the personal identifiable information you share with us. We also believe it is important to inform you about how we will use your personal data, and give you choices about how your data will be used.

We only use the information which is provided to help us improve our services to you, to provide you with the products and/or services you have requested and for other operational and internal purposes. Other than as described, AJ Horseboxes Ltd will not sell, trade or rent your personal information.

AJ Horseboxes Ltd will only collect your personal information (such as name, address, telephone number and a valid email address) if you provide them. If you do not want this information to be collected by u, please do not submit it. We will never pass any of these details on to any other party unless legally compelled to do so, and we will not retain your personal information longer than is necessary for the purpose for which it is collected.
